As indicated on the Intercept Schedule, the first distribution of the Pledged Revenues that is to be intercepted by the Distributing State Agency under the terms of this Intercept Agreement consist of Pledged Revenues due to the Obligor distributed in May 2026.
After the completion of the Interim Period, the Obligor agrees that all payments due on the Loan from the Pledged Revenues shall be paid by the Distributing State Agency to the Finance Authority or its designee, on behalf of the Governmental Unit, from scheduled distributions of the Pledged Revenues in accordance with the Intercept Schedule attached hereto as Exhibit “A” (the “Intercept Schedule”).
The obligation of the Pledge District to pay its portion of the Financing Costs and Operating Costs as provided herein (i.e., the Payment Obligation) shall constitute a limited tax general obligation of the Pledge District payable solely from and to the extent of the Pledge District Pledged Revenues.
This Agreement and the Payment Obligation shall constitute an irrevocable lien upon the Pledge District Pledged Revenues.
To the extent that any Pledge District Pledged Revenues constituting Financing Costs are released from the lien of the Financing Documents, the Issuing District shall continue to ensure that such revenues are applied to Financing Costs and any other costs of the Pledge District Public Improvements.
