Loss of Seniority definition
Loss of Seniority. Bus Drivers shall lose seniority and shall have their names removed from the seniority list in the event of retirement, resignation, discharge, failure to return to duty when recalled from layoff, failure to return to duty at the expiration of an approved leave of absence, failure to report for duty without just cause, or following twelve (12) months of layoff. After the first year of employment, "substitute" Bus Drivers will be removed from the seniority list and be deemed to have resigned if they have not maintained the required, mandatory training associated with their job.

It is understood that this article shall be administered pursuant to the Loss of Seniority provisions of this Agreement.
During the term of this leave, not withstanding Clause 9.2 Loss of Seniority, seniority will accrue for the duration of the approved leave.
The right of employees on the recall list to contribute to benefit plans under this Agreement shall continue for the period of seniority retention, subject to the provisions of Articles 10.05 (Loss of Seniority) and 10.07 (Recall).
Subject to Article 10.02 - Accumulation of Seniority and Article 10.04 - Loss of Seniority of this Agreement, an employee with the Saskatchewan Cancer Agency shall maintain accumulated seniority.
Upon completion of each work assignment and for the purposes of Clause 11.3(c) (Loss of Seniority), they shall re-establish their right to a further 12 months of recall.
More Definitions of Loss of Seniority
Loss of Seniority. The seniority of an employee shall be considered broken and the employment of the employee shall be terminated for the following reasons:
a. The employee resigns;
b. The employee retires;
c. The employee is deceased
d. The employee is discharged for just cause (if successfully appealed, all seniority rights shall be restored as if dismissal had not occurred, and the employee shall be reinstated in insurance programs on the same basis that exists at the time of reinstatement)
e. A lay off of duration longer than twenty-four (24) months;
f. Failure to return to work within ten (10) calendar days of a recall from layoff, absent extenuating circumstances (e.g.: illness, injury, or disability)
g. Failure to return to work at the expiration of a leave of absence, unless, for good and sufficient reason, the employee requests and is granted an extension of the leave at least five (5) work days before the scheduled date of return from the existing leave of absence.

Loss of Seniority. Any employee's seniority and employment shall terminate upon the occurrence of any of the following:

a. Voluntarily terminated;
b. Discharged and not reinstated under the terms of Section 41.03; or
c. Laid off and not recalled after two (2) years on the recall list under Article 38.

c) Absence from work for two (2) or more consecutive working days without notice or without an excuse considered reasonable by the Company;
d) Failure to return to work within seven (7) calendar days following a recall sent to the employee in writing to the last address known to the Company;
e) Refusal to accept a recall to the same status and classification occupied before the layoff;
f) Absence for reason of illness or accident, other than work related accident, exceeding twenty-four (24) calendar months;
g) A lay-off exceeding eighteen (18) calendar months;
h) A lay-off exceeding thirty (30) calendar months in the event of definitive cessation of pre-board screening at the airport where the employee performed his job at the moment of the cessation.
