Professional and Workmanlike Manner. The Contractor represents, warrants and covenants that all services to be performed under this Contract shall be performed in a professional, competent, diligent and workmanlike manner by knowledgeable, trained and qualified personnel, all in accordance with the terms and specifications of this Contract and the standards of performance considered generally acceptable in the industry for similar tasks and projects. In the absence of a specification for the performance of any portion of this Contract, the parties agree that the applicable specification shall be the generally accepted industry standard. So long as the Department notifies Contractor of any services performed in violation of this standard, Contractor shall re-perform the services at no cost to the Department, such that the services are rendered in the above-specified manner, or if the Contractor is unable to perform the services as warranted, Contractor shall reimburse the Department any fees or compensation paid to Contractor for the unsatisfactory services.
Professional and Workmanlike Manner. Consultant agrees to render all services generally and customarily performed in similar capacities in a professional and workmanlike manner in accordance with specifications furnished by Company. Consultant shall promptly comply with all instructions, directions, requests, rules and regulations of Company in connection with Consultant's services to be rendered under this Agreement.
Professional and Workmanlike Manner. Supplier represents, warrants and covenants that it shall perform the Services in a professional and workmanlike manner and in accordance with the terms and conditions of this Agreement and as set forth in each Order, including, to the extent applicable, all milestone delivery dates, performance specifications and service level agreements.

  • PROFESSIONAL AUTONOMY Teachers shall, within the bounds of the prescribed curriculum, and consistent with effective educational practice, have individual professional autonomy in determining the methods of instruction, and the planning and presentation of course materials in the classes of pupils to which they are assigned.

  • PROFESSIONAL IMPROVEMENT The parties’ support the principle of continuing training of teachers, participation by teachers in professional organizations in the areas of their specialization, leaves for work on advanced degrees or special studies, foreign travel and participation in community educational projects.

  • Professional Dues The school district will pay the annual dues for the Superintendent’s membership in the American Association of School Administrators, Association for Supervision and Curriculum Development, and Nebraska Council of School Administrators. The Superintendent’s membership in other professional organizations will be considered annually and may be approved at the discretion of the school board.

  • Professional Services Bodily injury" or "property damage" arising out of the rendering of or failure to render profes- sional services;

  • Professional Development and Training The Company shall pay for or reimburse the Executive for any reasonable professional development or training.

  • Professional Engineering and Architect’s Services Professional Engineering and Architect’s Services are not permitted to be provided under this Agreement. Texas statutes prohibit the procurement of Professional Engineering and Architect’s Services through a cooperative agreement.

  • Training and Professional Development 11.1 The Employer will develop and maintain an employee training and development plan and provide such plan to the Union upon request. Staff training is intended to provide an opportunity for classified staff employees for training sponsored by the University Training and Development and the UW Medical Centers Organizational Development and Training. Education/Professional Leave is intended to facilitate employee access to continuing education opportunities. Training and educational/professional leave may be used for the purpose of improving job performance, maintaining and increasing proficiency, preparing staff for greater responsibility, or increasing promotional opportunities within the framework of staff positions available at the University. 11.2 Any release time for training for employees accepted for such classes shall be in accordance with the Executive Order (currently No. 52) governing this matter. In the event that two or more employees request the same training period and supervision must limit the number of persons who may participate at one time due to work requirements, the selection will be made on a mutually agreeable basis within the department. 11.3 The training program is a proper subject for discussion by either departmental or University-wide Joint Union/Management Committees. 11.4 If the Employer requires an employee to receive training, reimbursement will be provided in accordance with the University travel rules. Employee attendance at Employer required training, either during or outside working hours, will be considered time worked and compensated in accordance with the provisions of this Agreement. 11.5 Employee attendance at training not required by the Employer and not covered by Executive Order 52, either on approved leave from or outside of working hours, will be voluntary and not considered time worked.

  • Professional Activities The Superintendent is expected to attend appropriate professional meetings at the local and state levels, and, subject to prior Board approval, at the national level. All reasonable expenses incurred shall be paid by the Board.

  • Professional Rights A Pharmacist in his professional judgment may delay or refuse to fill or refill any prescription if there is reason to believe that such action would protect the health of the patient or where reasonable doubt exists as to the legality of said prescription or the legal use thereof, after first having established the fact by having consulted the prescriber if said prescriber is available.

  • PROFESSIONAL DEVELOPMENT AND EDUCATIONAL IMPROVEMENT A. The Board shall provide financial reimbursement for college and technical school credits taken by teaching personnel who hold a permanent certificate or above and for all other employees, subject to the following regulations and provisions: 1. A teacher must be fully certified. Secretaries and custodians must have completed three (3) years in the District at the time the course(s) commenced. 2. Applications for reimbursement shall be made in writing to the Superintendent outlining desired course, college or technical school to be attended and all other pertinent information. All courses must be part of a curriculum leading to an Undergraduate or Graduate Degree or be directly related to area of employment. 3. All courses and the college or technical school at which the course is to be taken must be approved by the Superintendent prior to enrollment to qualify for reimbursement. 4. The maximum annual reimbursement by the Board to full-time teachers, custodians, secretaries, and non-certificated staff who qualify under A., A.I., A.2., and A.3., A.7. and A.8. shall be for a total of nine (9) college credits for Graduate and Undergraduate level courses at the Rutgers University rate. 5. Employees who work less than full-time shall be eligible for pro-rated reimbursement under 4. and 5. above if they qualify under A., A. I., A.2., A.3., A.7. and A.8. 6. Reimbursement will not be made until after successful completion of the course and after an official transcript has been received by the Superintendent of Schools. Reimbursement shall be made pursuant to the following schedule: For a grade of A or B 100% reimbursement For a grade of C 60% reimbursement 7. No reimbursement will be made for credits for which a grant or other payment covering such costs is received by the employee. 8. Technical school courses and in-service credits shall not count towards movement across the guide on graduate level columns. Undergraduate coursework shall only count for column movement if the employee does not hold a B.A. degree.
