Email Notice. Any reference in this Agreement to “written notice” shall include notice by email, where there is reasonable certainty that such email notice originated either from a valid OANDA email address, or from the email address registered to your Account, as the case may be, and may be relied upon as valid and authentic written communication.

Email Notice. In the event you elect to receive automatic email notice of certain System events, e.g., the arming or disarming of the System, you acknowledge, understand and agree that (I) any such notice is conditioned on (a) receipt of the data at Company’s central station, (b) the proper operation of communication equipment, services, systems and networks including, without limitation, the internet, and (c) any failure, malfunction or delay in processing or transmitting the data by Company’s equipment or software, and (II) Company is hereby released from any liability arising out of or from, resulting from or in connection with the failure, malfunction or delay of any such notice for any reason, including Company’s or Representative’s sole, joint or several negligence of any kind or degree.

Email Notice. The summary notice of the settlement that is emailed to Settlement Class Members pursuant to Section 4, providing a link to the Claim Form, a link to the Settlement Website, and contact information for the Settlement Administrator. The Email Notice submitted to the Court for approval must be substantially in the form attached as Exhibit 4.

Email Notice. The Settlement Administrator will send an Email Notice to each Settlement Class Members with a valid email address provided by R+F. The Email Notice shall be substantially similar to the form attached as Exhibit C and will provide the web address of the Settlement Website and an email and mailing address to contact the Settlement Administrator. The Settlement Administrator will provide the Email Notice on or before sixty (60) calendar days after entry of the Preliminary Approval Order.

Email Notice. The Settlement Administrator will email each member of the Settlement Class for whom Apple has an email address a copy of the email notice substantially in the form attached hereto as Exhibit B.

Email Notice. By no later than thirty-five (35) Days after the Preliminary Approval Date, the Settlement Administrator will send the Email Notice (substantially in the form attached to the Settlement as Exhibit B) by email to all persons on the Settlement Class Notice List for whom an email address was provided by American or located by the Settlement Administrator.

Email Notice. Notice of Committee Meetings and /or Committee Meeting Agendas is to be given by email and sent to the email addresses of Delegates provided in the Committee rosters. Notice will be deemed to have been given at the time of the sending of the email.

Email Notice. The Settlement Administrator shall provide for Email Notice by sending an email substantially in the form of Exhibit A to the email addresses for Settlement Class Members identified by Defendant. Defendant is in possession of approximately 800,000 such email addresses. This contact information will be shared with the Settlement Administrator but not Class Counsel or any other party or individual.

Email Notice. Defendants and the Settlement Administrator shall use reasonable efforts to identify their customers who made a Qualifying Purchase who may be Settlement Class Members and for whom an email address can be determined from Defendants’ records or other sources available to the Settlement Administrator. The Settlement Administrator will send an Email Notice to those Settlement Class Members for whom Defendants have, or the Settlement Administrator can find, an email address. The Email Notice shall be substantially similar to the form attached as Exhibit B, and will provide the web address of the Settlement Website with a live, clickable, user-friendly link, as well as an email and mailing address to contact the Settlement Administrator. The Settlement Administrator will provide the Email Notice within sixty (60) calendar days after entry of the Preliminary Approval Order. The Email Notice shall include a disclaimer stating that the email is a legal communication being sent pursuant to a court order and is not being sent by or on behalf of Defendants.
