Cost of the Work for Construction Phase. 6.1 Cost of Work Items. Cost of Work items shall be at rates not higher than those customarily paid at the place of the Project except with prior consent of the City. The Cost of Work shall include only the items set forth in this Article.

Cost of the Work for Construction Phase. § 7.2.1 Labor Costs (fixed): $1,428,800, based on the following staffing plan: Breakdown: Project Manager – 30 hrs/week for 16 months = $230,400 Full Time Site Superintendent – 45 hrs/week for 14 months = $277,200 Full Time Site Superintendent – 45 hrs/week for 14 months = $277,200 Full Time Site Superintendent – 45 hrs/week for 14 months = $277,200 Full Time Site Superintendent – 45 hrs/week for 14 months = $277,200 General Superintendent – Blended in Above Safety Officer – 1 audit/week/site for 14 months = $89,600 Client Advocate (Xxxx Xxxxx) = No Charge Vice President (Xxx Xxxxxxxxxxxx) = No Charge The fixed General Conditions expenses are based on 14 month construction duration. In the event the construction of the Project exceeds or falls short of the 14 month duration, the General Conditions shall be renegotiated by the parties, in good faith, based on the hourly rates provided above.
Cost of the Work for Construction Phase. § 7.1 Costs to Be Reimbursed
§ 7.1.1 The term Cost of the Work shall mean costs necessarily incurred by the Construction Manager in the proper performance of the Work. The Cost of the Work shall include only the items set forth in Sections 7.1 through 7.7.
§ 7.1.2 Where, pursuant to the Contract Documents, any cost is subject to the Owner’s prior written approval, the Construction Manager shall obtain such approval in writing prior to incurring the cost. The parties shall identify any such costs prior to executing any Guaranteed Maximum Price Amendment.
§ 7.1.3 Costs shall be at rates not higher than the standard rates paid at the place of the Project, except with prior written approval of the Owner.

§ 7.1.1 The term Cost of the Work shall mean costs necessarily incurred by the Construction Manager in the proper performance of the Work. The Cost of the Work shall include only the items set forth in Sections 7.1 through 7.7.
§ 7.1.1.1 Notwithstanding anything contained in herein to the contrary, the Construction Manager shall include all reimbursable staffing and general condition costs including but not limited to its own labor, general requirements, staff costs, supervision, cleanup costs, temporary facilities, and other costs identified in the Construction Manager’s Staffing Plan and General Conditions exhibits based on an agreed upon not to exceed line items, which amounts shall be included in the GMP Amendment(s). The Construction Manager shall include its Construction Manager’s Staffing Plan and General Conditions costs on its pay applications charged on a negotiated hourly basis, using the Personnel Billing Rates Exhibit F or as otherwise agreed by the Parties in the GMP Amendment. Rates shall be in effect for the duration of the Project with no annual increases. The Construction Manager’s Staffing Costs shall not exceed $853,844 for the Project based on an 18-month construction schedule using the rates contained in Exhibit F. The Construction Manager’s General Condition costs shall not exceed $47,286 for the Project based on an 18-month construction schedule using the rates contained in Exhibit G.
§ 7.1.2 Where, pursuant to the Contract Documents, any cost is subject to the Owner’s prior approval, the Construction Manager shall obtain such approval in writing prior to incurring the cost. The Construction Manager waives any claim for costs not so approved in advance in writing by the Owner. The parties shall endeavor to identify any such costs prior to executing Guaranteed Maximum Price Amendment.
